3.3 evaluate ways in which concerns about poor practice can be reported whilst enduring that whistleblowers and those whose practice or behaviour I'd being questioned are protected
The current law relies on the employer having policies and procedure’s on whistle blowing, however these are bits of paper and offer no protection what so ever. [ Case law that sends out a strong message is what is needed, if you google the words “UK whistle blower wins record damages” nothing comes up. There lies the worth of PIDA. The current law encourages a worker to report the wrong doing to their employer first, however should the employer fail to act the worker is left in a position where if they go outside for help their employer will know who it is, the requirements of the law make
it more likely that the wrong doing will never be exposed. A worker is allowed to report directly to a approved authority but even when that authority investigates and upholds all the whistle blowers allegations this is completely ignored by an employment tribunal. Should a worker require the protection of the law they will need to save up before reporting the abuse. A whistle blower is strongly encouraged to settle out of court or they can be liable for their employers legal costs, yet this results in the wrong doing never being made public. These are just a few of the flaws. ]
