How does "due process" applies to the criminal justice system?
Weegy:
In United States law, adopted from the Magna Carta, due process (more fully due process of law) is the principle that the government must respect all the legal rights, not just some or most of those legal rights, [ when the government deprives a person of life, liberty, or property. The right to due process is enshrined in the U.S. Constitution and Bill of Rights, appearing in both its Fifth Amendment and Fourteenth Amendment. Due process has also been frequently interpreted as placing limitations on laws and legal proceedings, in order for judges instead of legislators to guarantee fundamental fairness, justice, and liberty. The latter interpretation is analogous to the concepts of natural justice and procedural justice used in various other jurisdictions. In all cases, due process, whether codified or not, is considered a fundamental right of all people and essential to the establishment of a society of harmony justice. ]
