What is this the most effective approach to determine the guilt of a defendant?
One often hears anecdotes of guilty people going free; in fact in my years of practicing law, it happened to me on occasion. I was not happy with the decision: I felt that punishment was deserved. [ Still, I defended the person to the best of my ability. No tricks, stunts, or anything of that nature. I simply offered the best defense possible. Therein lies one of the imperfections of the adversarial system. Then again, we all know of instances in which people punished for serious crimes turned out to be innocent. Were we to abandon an adversarial system, and move toward Star Chamber, the
odds of such occurrences will be multiplied. It's not perfect, but it's the best we can do. ]
