[ Because of this, DNA evidence collected from a crime scene can be used like a fingerprint to include or exclude a suspect in a particular case. It can also be used to link crime scenes either locally or on a state or national level. The primary purpose of DNA evidence in a sexual assault case is thus to identify an assailant and/or to prove sexual contact. Experienced investigators often say that they rejoice when a suspect denies engaging in sexual contact with the victim, because the case then provides the opportunity to make full use of forensic technology. As we’ve stated repeatedly throughout this manual, however, the vast majority of sexual assaults are committed by someone known to the victim. In these cases, identification is not the issue because the defense will probably claim that the sexual activity was consensual. The value of DNA evidence in these cases where the victim and suspect know each other is therefore minimal. ] (More)
