The alternatives to litigation include mediation and arbitration - where a neutral unbiased third party takes a look at the issue and makes a binding decision.

This would impact prisoners as right now the judicial system can get bogged down by lawsuits from prisoners. If an alternative system like one mentioned above was more abundant than it would take pressure off the judicial system. However, inmates have the right under the constitution to utilize the courts if they desire.

If a valid and reliable system could be incorporated in the prison system using these non litigation methods that was seen by both the prison and prisoners as being fair, then it might provide a usage there and allow for non-court allowances for certain issues.

In addition, prisons need to ensure that they have a uniform code that is applicable to all inmates as this reduces the litigative power of the prisoner (the likelihood of them winning litigation).
